WHEREAS, the Mountain Lakes Red Trail bridge is a historic stone arch bridge dating to the time of the Princeton Ice Company’s operations between 1884 and the 1920s; and

 

WHEREAS, the bridge was determined to be in a significant state of disrepair and, in 2021, an application was made to the New Jersey Historic Trust for a grant to offset the cost of the work required for rehabilitation; and

 

WHEREAS, the New Jersey Historic Trust awarded a grant of $395,218.00 to Princeton to effect the rehabilitation of the Red Trail stone arch bridge; and

 

WHEREAS, designs for the rehabilitation of the Red Trail bridge and replacement of the Green Trail bridge were completed and bids were solicited and received in 2025: and

 

WHEREAS, by Resolution 25-138 adopted on April 14, 2025, Princeton Council awarded a contract to Colonnelli Brothers, Inc. for the Rehabilitation/Replacement of Two Pedestrian Footbridges in the Mountain Lakes Preserve for an amount not to exceed $947,200.00; and

 

WHEREAS, upon commencement of work and dismantling of the bridge it was discovered that the stone arch and the wingwall footings were in a condition that was unforeseen at the time of design, including large stones protruding vertically above the stone arch and footings that were no longer in alignment to facilitate reconstruction of the wingwalls; and

 

WHEREAS, in order to fully evaluate the conditions, redesign the arch and new footings, and negotiate additional costs, Princeton suspended the work and Colonnelli Brothers, Inc. demobilized for the duration of the suspension; and

 

WHEREAS, negotiations between Princeton and Colonnelli Brothers, Inc., in good faith, resulted in a compromise of a reasonable cost to complete the additional work of remobilizing, demolition of the existing footings, forming and constructing new reinforced concrete footings, and constructing a modified reinforced concrete arch relief slab; and

 

WHEREAS, the negotiated cost of this construction due to unforeseen conditions is $314,670.00, which is an increase of 33.221% of the original contract total, resulting in a new not-to-exceed construction contract amount of $1,261,870.00; and

WHEREAS, Princeton has complied with the requirements of N.J.S.A. 40A:11-16.7 et seq. regarding changed conditions for construction contracts and N.J.A.C. 5:30-11.9 et seq regarding the approval process for change orders which exceed the 20 percent limitation; and

 

WHEREAS, Princeton Engineering staff recommend authorizing Change Order #1 to Colonnelli Brothers Inc. in the amount of $314,670.00 and an extension of time to complete the work of 120 days;

 

NOW, THERFORE, BE IT RESOLVED by the Council of the Municipality of Princeton, County of Mercer, State of New Jersey, as follows

:

1.                     The Mayor and Council hereby authorize Change Order #1 to the contract with Colonnelli Brothers, Inc. for the Rehabilitation/Replacement of Two Pedestrian Footbridges in the Mountain Lakes Preserve Bid originally awarded by Resolution 25-138 on April 14, 2025, to increase the contract amount by $314,670.00 for a new amount not to exceed $1,261,870.00, and extend the time for the completion of work to 120 days.

 

2.                     The governing body will print a brief notice indicating the additional amount to be expended, the original contract price, the nature of the original and additional work, and why it is necessary to expend additional funds.

 

3.                     A copy of this Resolution and the Change Order Document shall be placed on file in the Office of the Clerk.
