Resolution of the Mayor and Council of Princeton Authorizing an Increase of $6,500.00 to the Not to Exceed Amount for the Professional Services Agreement with PS&S, LLC for Professional Engineering Services in Connection with the Terhune Road Pedestrian Improvements Project for a New Not to Exceed Amount of $185,000.00

WHEREAS, by Resolution 24-238 adopted on August 12, 2024, Council awarded a contract to PS&S, LLC for professional engineering services in connection with the Terhune Road Pedestrian Improvement project for an amount not to exceed $143,000.00 with the anticipated completion date of April 30, 2026; and
WHEREAS, by Resolution 25-143 adopted on April 14, 2025, Council authorized an increase of $10,500.00 for a new not to exceed amount of $153,500.00; and
WHEREAS, by Resolution 25-233 adopted on July 14, 2025, Council authorized an increase of $25,000.00 for a new not to exceed amount of $178,500.00; and
WHEREAS, additional engineering services will be needed that were not part of the original contract; and
WHEREAS, it is recommended to increase the current contract amount by $6,500.00 for a new not to exceed amount of $185,000.00; and
WHEREAS, the Chief Financial Officer has certified that sufficient funds are available to pay for said services from 04-215-23-021-076-331.
NOW, THEREFORE, BE IT RESOLVED by the Council of Princeton, County of Mercer, State of New Jersey, as follows:
1. The Mayor and Council, or their designee, hereby authorize the amendment to the professional services agreement originally authorized by Resolution 24-238 on August 12, 2024, and amended by Resolution 25-143 on April 14, 2025, and amended by Resolution 25-233 on July 14, 2025, between Princeton and PS&S, LLC for Professional Engineering Services in Connection with the Terhune Road Pedestrian Improvement Project to increase the not to exceed amount by $6,500.00 for a new not to exceed amount of $185,000.00.
2. All remaining provisions of the original agreement not otherwise amended by or inconsistent herewith shall remain in full force and effect.
3. This Resolution, when countersigned by PS&S, LLC, shall serve as the third amendment to the original agreement.
