Resolution of the Mayor and Council of Princeton Authorizing an Amendment to the Term of the Professional Services Agreement with H2M Associates, Inc. for Engineering Design, Contract Administration, and Reporting Services in Connection with the Cleaning and Televising of Sanitary Sewer Trunk Lines with No Change to the Contract Total

WHEREAS, by Resolution 23-173 adopted on May 8, 2023, Princeton Council awarded a professional services agreement to H2M Associates, Inc. for Engineering Design, Contract Administration, and Reporting Services in Connection with the Cleaning and Televising of Sanitary Sewer Trunk Lines for a not to exceed amount of $19,800.00 and term of one year; and
WHEREAS, by Resolution 24-159 adopted on May 28, 2024, Princeton Council authorized an increase to the professional services agreement with H2M Associates, Inc. for an amount not to exceed $33,900.00 for a new not to exceed amount of $53,700.00 and extended the expiration of the contract to May 31, 2025; and
WHEREAS, services will be required after May 31, 2025, through the completion of the associated construction contract; and
WHEREAS, pursuant to N.J.S.A. 40A:11-15 (9), all contracts for professional services shall be awarded for a period not to exceed 12 consecutive months except that any public works project, including the retention of the services of any engineer in connection therewith, may be authorized for the length of time necessary for the completion of the actual construction; and
WHEREAS, there will be no change to the total amount of the contract.
NOW, THEREFORE, BE IT RESOLVED:
by the Council of Princeton, County of Mercer, State of New Jersey, as follows:
1. The Mayor and Council, or their designee, hereby authorize an amendment to the agreement with H2M Associates, Inc., originally authorized by Resolution 23-173 on May 8, 2023, and amended by Resolution 24-159 on May 28, 2024, to authorize the Agreement for Engineering Design, Contract Administration, and Reporting Services in Connection with the Cleaning and Televising of Sanitary Sewer Trunk Lines for the length of time necessary for the completion of the actual construction with no change to the contract amount.
2. All remaining provisions of the original agreement not otherwise amended by or inconsistent herewith shall remain in full force and effect.
3. When countersigned by H2M Associates, Inc., this resolution shall serve as the second amendment to the original agreement between the parties.
4. A copy of this resolution will be kept on file in the Office of the Clerk.
