Resolution of the Mayor and Council of Princeton Authorizing an Increase of $4,200.00 to the Not to Exceed Amount for the Professional Services Agreement with Manns Woodward Studios, Inc. for Princeton Fire Department Headquarters Conceptual Designs for a New Not to Exceed Amount of $63,000.00

WHEREAS, by Resolution 24-344 adopted on November 25, 2024, Princeton Council awarded a professional services agreement to Manns Woodward Studios, Inc. (“MW Studios”) for Princeton Fire Department Headquarters Conceptual Designs for a not to exceed amount of $58,800.00 and term of twelve months; and
WHEREAS, additional services will be needed to complete the conceptual designs; and
WHEREAS, pursuant to N.J.S.A. 40A:11-15 (9), all contracts for professional services shall be awarded for a period not to exceed 12 consecutive months except that any public works project, including the retention of the services of any engineer in connection therewith, may be authorized for the length of time necessary for the completion of the actual construction; and
WHEREAS, MW Studios has provided a proposal for the additional services in the amount of $4,200.00; and
WHEREAS, the Chief Financial Officer has certified that sufficient funds are available to pay for said services from 04-215-23-021-052-308.
NOW, THEREFORE, BE IT RESOLVED by the Council of Princeton, County of Mercer, State of New Jersey, as follows:
1. The Mayor and Council, or their designee, hereby authorize the first amendment to the agreement originally authorized by Resolution 24-344 on November 25, 2024, to increase the not to exceed amount by $4,200.00 for a new not to exceed amount of $63,000.00, and a term that is authorized for the length of time necessary for the completion of the actual construction.
2. All remaining provisions of the original agreement not otherwise amended by or inconsistent herewith shall remain in full force and effect.
3. This Resolution, when countersigned by Manns Woodward Studios, Inc. shall serve as the first amendment to the original agreement between the parties.
4. Notice of this action shall be published in the official newspaper as required by law.
5. A copy of this resolution will be kept on file in the Office of the Clerk.
