WHEREAS, on February 12, 2024, Princeton and the Princeton Tennis Program ("PTP"), a nonprofit corporation of the State of New Jersey, executed a Lease Agreement to enable PTP to operate tennis programming on twelve of the fifteen courts at the Community Park South Tennis Facility, which is located at Princeton Community Park South, designated as Block 69.02, Lot 2 on the Princeton Tax Map ("2024 Lease Agreement"); and

WHEREAS, the 2024 Lease Agreement provided for an initial one-year term (March 1, 2024 to February 28, 2025), with the ability of the parties to renew the 2024 Lease Agreement for up to two additional one-year terms; and

WHEREAS, by Resolution No. 25-44, Princeton Council authorized the renewal of the 2024 Lease Agreement for a one-year term (March 1, 2025 to February 28, 2026) on the basis that PTP's continued provision of tennis programming at the Community Park Tennis Facility promotes the health, safety, morals and general welfare of the Princeton community; and

WHEREAS, at this time the parties seek to renew the 2024 Lease Agreement for a second one-year term, to commence on March 1, 2026 and terminate on February 28, 2027, on the basis that PTP's continued provision of tennis programming at the Community Park Tennis Facility promotes the health, safety, morals and general welfare of the Princeton community; and

WHEREAS, pursuant to the 2024 Lease Agreement and applicable rules of the Green Acres Program (and in particular N.J.A.C. 7:36-25.13), the renewal of the 2024 Lease Agreement has been approved by the New Jersey Department of Environmental Protection.

NOW, THEREFORE, BE IT RESOLVED, by the Council of the Municipality of Princeton, County of Mercer, State of New Jersey, as follows:
