Resolution of the Mayor and Council of Princeton Authorizing the Award of a Professional Services Agreement to T&M Associates for Corrective Measures, Environmental Permitting, and Construction Administration/Construction Inspection for the Closure of the Princeton Sanitary Landfill for Amount Not to Exceed $312,453.00

WHEREAS, Princeton has a need for corrective measures, environmental permitting, and construction administration/construction inspection services in connection with the closure of the Princeton Sanitary Landfill; and
WHEREAS, it has been determined that the value of the contract will exceed $44,000; and
WHEREAS, T&M ("T&M") Associates has provided a proposal for these services for an amount not to exceed $312,453.00; and
WHEREAS, pursuant to N.J.S.A. 40A:11-5(1)(a)(i) of the Local Public Contracts Law, Princeton may award a contract for professional services without public advertising for bids; and
WHEREAS, pursuant to N.J.S.A. 40A:11-15 (9), all contracts for professional services shall be awarded for a period not to exceed 12 consecutive months except that any public works project, including the retention of the services of any engineer in connection therewith, may be authorized for the length of time necessary for the completion of the actual construction; and
WHEREAS, this contract is not being awarded as a "fair and open" contract as defined in N.J.S.A. 19:44A-20.7; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.5., Princeton may award a non-fair and open contract to a business entity if, during the preceding one-year period, that business entity has not made a contribution that is reportable by the recipient under P.L. 1973, c.83, N.J.S.A. 19:44A-1 et seq. to any municipal committee of a political party in that municipality if a member of that political party is serving in an elective public office of that municipality when the contract is awarded or to any candidate committee of any person serving in an elective public ...
