Resolution of the Mayor and Council of Princeton Authorizing the Award of a Bid Contract to Waters & Bugbee, Inc. for Hamilton Avenue Sewer Rehabilitation for an Amount Not to Exceed $5,672,325.00

WHEREAS, in response to a Notice to Bidders duly posted pursuant to N.J.S.A. 40A:11-1 et seq. on July 10, 2026, the Municipality of Princeton received and publicly opened the following two (2) bids for the Hamilton Avenue Sewer Rehabilitation bid:
$2,792,210.00 from Montana Construction Corp. Inc. of Lodi, New Jersey
$5,672,325.00 from Waters & Bugbee, Inc. of Hamilton, New Jersey
WHEREAS, the bid submitted by Montana Construction Corp. Inc. failed to acknowledge the addendum issued on July 28, 2026; and
WHEREAS, pursuant to N.J.S.A. 40A:11-23.2 (e.), the acknowledgement of addenda is a mandatory item to be submitted at the time specified by Princeton for the receipt of bids, and failure to submit any one of the mandatory items shall be deemed a fatal defect that shall render the bid proposal unresponsive; and
WHEREAS, the bid submitted by Montana Construction Corp. Inc. must be rejected as unresponsive; and
WHEREAS, department personnel and the Qualified Purchasing Agent have reviewed the bids and determined that the bid submitted by Waters & Bugbee, Inc. is a responsible and responsive bid, and recommend that a contract be awarded to Waters & Bugbee, Inc. for Hamilton Avenue Sewer Rehabilitation; and
WHEREAS, the New Jersey Department of Environmental Protection agrees with the recommendation of award and issued an Authorization to Award on September 23, 2026; and
WHEREAS, the Certified Financial Officer certifies that the Municipality of Princeton has appropriated sufficient funds for these services in the following budget accounts:

04-215-23-017-089-301 $2,613.86
04-215-24-017-089-303 $2,947,111.92
04-215-24-018-089-301 $10,525.00
